Risk Disclaimer
1.Nothing here is advice
Everything FloSignals publishes or shows — indicators, charts, heatmaps, footprints, order-flow statistics, journal analytics, backtests, scripts and answers from an assistant, posts, videos, streams and messages in the Discord — is general information for your own education and research. None of it is investment, financial, trading, legal, tax or suitability advice, and none of it is a recommendation, solicitation or offer to buy or sell any asset, contract or security.
Despite the name, FloSignals does not send trade signals or tell you when to buy or sell. The indicators draw what the market did; what you do with that is yours.
Nothing is tailored to you. We do not know your finances, your goals or your tolerance for loss, and the software does not ask. If you want advice, get it from someone licensed to give it where you live.
FloSignals publishes software and general commentary of regular and general circulation. It is not registered as an investment adviser with the US Securities and Exchange Commission or any state, and it is not registered as a commodity trading advisor with the CFTC; it relies on the exclusion for publishers in section 202(a)(11)(D) of the Investment Advisers Act of 1940, on the corresponding exclusion in the Commodity Exchange Act, and on their equivalents elsewhere. Nothing it provides is personal to you or takes your circumstances into account. [counsel to confirm the CEA wording and whether any non-US regime (UK financial-promotion rules, EU MiCA) needs its own line]
Posts, charts and messages from other members are their own opinion. We do not check them, we do not endorse them, and we are not liable for anything you do because of them.
2.Trading can lose you money
Trading any market carries a substantial risk of loss. Cryptocurrency is volatile; perpetual futures are leveraged, and leverage means a small move against you can take your whole margin and, on some venues, more. Positions can be liquidated by the exchange without warning. Never trade with money you cannot afford to lose entirely.
You alone decide what to trade, when, in what size and with what leverage. You alone bear the result. Using FloSignals does not change that, and it does not make any trade safer.
3.Backtests, statistics and hypothetical results
A backtest, a strategy drafted in Quant, a win rate or an expectancy in the journal, and any other number that describes what a method did on past data is hypothetical. It is computed with hindsight, on data that may be incomplete, without the fills, slippage, fees, funding, outages and hesitation a live account meets, and it reflects the settings and the criteria you chose. Such results are routinely better than what the same method does live, and a method that worked on the past can stop working at any time.
Hypothetical and simulated results have many inherent limitations. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown. One limitation is that they are prepared with the benefit of hindsight and do not involve financial risk; no hypothetical record can account for the effect of risk on actual trading. Nothing on the service has been reviewed or approved by any regulator.
Figures shown on our marketing pages, in screenshots and in demonstrations are illustrative sample data unless we say otherwise; they are not anyone's results.
Journal figures describe your past trades only. They are a record, not a forecast, and a good month says nothing about the next one.
Past performance — ours, yours, anyone's — is not indicative of future results.
4.Market data can be wrong, late or missing
FloCharts draws from public exchange feeds and from the minutes our recorder has stored. Feeds lag, drop and reconnect; the recorder has gaps for every moment it was not running; the same instrument looks different on different venues; and the chart's rendering is a summary of that data at the zoom you are at, not the exchange's own book. Nothing on the chart is guaranteed accurate, complete, timely or continuous, and you should not place a trade on a number you have not checked on the exchange itself.
Market data on the chart is published by Toobit, Binance, Bybit and the other venues named on the chart. Each venue disclaims the accuracy and completeness of its data in its own terms, and those disclaimers apply here too. None of those venues sponsors or endorses FloSignals.
The same indicator can show different values on TradingView, on FloCharts and on other platforms, because feeds, timestamps, rounding, bar construction and funding assumptions differ. A number on one is not a check of the other.
5.Alerts and automation
Alerts, notifications and anything that fires on a condition are informational. We do not guarantee they fire, that they fire on time, or that they reach you. Anything you automate on top of them — through a webhook, or in your own code — is yours to build, test and supervise.
TradingView's terms forbid using its content for automated trading. If you use our indicators there, that rule is yours to keep; nothing we publish is an invitation to break it.
6.Live trading from the chart
FloCharts can send orders to a Toobit account you own. When it does, the order is yours: you chose it, your key signed it, your account holds the position. FloSignals is not a broker, an exchange, a custodian, a fund or an adviser, is not registered as any of those with any regulator, does not hold your money, and does not place, manage, hedge, reverse or guarantee any order. Orders are live from the moment the session is connected, and the chart places exactly the order you submit, with no size, loss or frequency limit of its own. Live trading may be limited to some members or switched off at any time.
Before your first live connection the chart asks you to confirm all of this in your own words, and we keep what you typed and when, as the Terms of Use describe.
The relay that carries your signed request to the exchange can be slow or down, and so can the exchange. An order may be delayed, duplicated, rejected or lost; a position you hold while that happens is still yours to manage. Keep your own access to the exchange so you can act without us.
7.What we say about our own results
When we show a backtest, a statistic or a trade of ours, we show the settings, the period, the fees and slippage assumed and the number of trades, and we say when it is hypothetical. We do not claim or guarantee future performance, and we do not pay for or script testimonials.
8.Testimonials
Any quote from a member on our site is from a real member, used with their permission, describing their own experience of the software. It is not typical, not a claim about results, and not a promise of what you will experience. Where a member or a partner we quote has received something from us — free access, a payment or a referral fee — we say so next to the quote. No member, and no one at FloSignals, trades your account or has access to it.
9.Our relationships with exchanges and partners
We may receive a referral fee or another benefit from an exchange or a service when you open an account through a link or an invite code we provide. That does not change our view that no venue is right for everyone, it does not mean we recommend, vouch for or are responsible for that venue, and it does not change your fees unless the venue says so. We say so here whenever we are paid by a venue we link to.
Toobit. FloSignals has a partnership with Toobit. If we give you a link or an invite code to open a Toobit account, Toobit may pay us a referral fee or a share of your trading fees; that does not change what you pay Toobit. [owner to confirm the exact terms of the Toobit partnership (fee or fee share, and on what)]
10.TradingView and Pine Script
"TradingView" and "Pine Script" are trademarks of TradingView, Inc. Our indicators run on TradingView's platform; FloCharts and FloScript are our own independent software and are not affiliated with, sponsored by or endorsed by TradingView. TradingView's own terms, disclaimers and data rules apply when you use anything there.
11.No guarantee of any kind
No indicator, script, model, strategy, setting, lesson or feature of FloSignals is guaranteed to produce a profit, avoid a loss or give an edge. Anyone who tells you it does is not speaking for us.
